Scope and Applicability<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This Policy applies to all voice calls, SMS\/MMS messages, ringless voicemail (where permitted), prerecorded or artificial-voice messages, and any other telecommunication initiated by or on behalf of Reinvest Safe or its Partners.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Inbound and outbound communications<\/li>\n\n\n\n<li>Automated and manual dialing<\/li>\n\n\n\n<li>First-party and third-party (Partner) communications<\/li>\n\n\n\n<li>Marketing, informational, and transactional messages<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">2. Regulatory Framework<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Telephone Consumer Protection Act (TCPA)<\/li>\n\n\n\n<li>FCC rules and declaratory rulings<\/li>\n\n\n\n<li>National and State Do-Not-Call Registries<\/li>\n\n\n\n<li>State telemarketing and consumer-protection laws<\/li>\n\n\n\n<li>FTC deceptive-practices standards<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">3. Definitions (Aligned with TCPA)<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>&#8220;Automatic Telephone Dialing System\/ATDS&#8221; \u2014 <\/strong>Equipment with the capacity to store or produce telephone numbers to be called using a random or sequential number generator and to dial such numbers.<\/li>\n\n\n\n<li><strong>&#8220;Express Written Consent&#8221; \u2014 <\/strong>A clear and unambiguous agreement bearing the consumer&#8217;s signature (including electronic) authorizing calls\/text messages using an ATDS or prerecorded voice.<\/li>\n\n\n\n<li><strong>&#8220;Marketing Message&#8221; \u2014 <\/strong>Any communication that promotes or advertises products or services.<\/li>\n\n\n\n<li><strong>&#8220;Transactional Message&#8221; \u2014 <\/strong>Communications related to an existing inquiry, request, or relationship.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">4. Consent Collection Standards<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Consent is collected at the point of data entry through clear and conspicuous disclosures that are not a condition of purchase.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Disclosure of automated\/prerecorded communications<\/li>\n\n\n\n<li>Identification of the calling\/texting parties<\/li>\n\n\n\n<li>Consent applies to the number provided<\/li>\n\n\n\n<li>Affirmative action (checkbox, submit action)<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">5. Stored Consent Data Elements<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Full consent text as displayed<\/li>\n\n\n\n<li>Date and time (with time zone)<\/li>\n\n\n\n<li>IP address<\/li>\n\n\n\n<li>Page URL and form identifier<\/li>\n\n\n\n<li>User agent and device metadata<\/li>\n\n\n\n<li>Campaign parameters and traffic source<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">6. Consent Lifecycle Management<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Consent is recorded and retained for evidentiary defense<\/li>\n\n\n\n<li>Consent is portable among compliant Partners<\/li>\n\n\n\n<li>Consent may be revoked at any time<\/li>\n\n\n\n<li>Revocation is honored across all systems<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">7. Reassigned Numbers and Wrong-Party Safeguards<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">We implement commercially reasonable safeguards to reduce the risk of reassigned numbers.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Carrier and database checks where available<\/li>\n\n\n\n<li>Monitoring of opt-outs and complaints<\/li>\n\n\n\n<li>Immediate suppression upon notification<\/li>\n\n\n\n<li>Internal escalation and investigation<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">8. Frequency, Purpose, and Time-of-Day Controls<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Communications are limited to the scope of consent<\/li>\n\n\n\n<li>Reasonable frequency limits apply<\/li>\n\n\n\n<li>Calls\/messages are limited to permitted hours<\/li>\n\n\n\n<li>Jurisdiction-specific restrictions apply<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">9. Do-Not-Call (DNC) Compliance<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The National Do-Not-Call Registry is honored<\/li>\n\n\n\n<li>Internal Do-Not-Call lists are maintained<\/li>\n\n\n\n<li>Immediate DNC flagging upon request<\/li>\n\n\n\n<li>Partners must comply with DNC obligations<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">10. Opt-Out Mechanisms<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>SMS: Reply STOP or an equivalent keyword<\/li>\n\n\n\n<li>Email: Unsubscribe link in the footer<\/li>\n\n\n\n<li>Calls: Verbal opt-out or support request<\/li>\n\n\n\n<li>All opt-outs are processed promptly and permanently<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">11. Partner and Vendor Obligations<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Partners who receive leads or consent must contractually agree to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Use the data only within the scope of consent<\/li>\n\n\n\n<li>Honor opt-outs and DNC requirements<\/li>\n\n\n\n<li>Maintain TCPA compliance programs<\/li>\n\n\n\n<li>Provide records upon audit or inquiry<\/li>\n\n\n\n<li>Indemnify for violations caused by the Partner&#8217;s conduct<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">12. Call Recording and Monitoring (Where Permitted)<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Calls may be monitored or recorded for quality assurance, compliance, and dispute resolution, subject to applicable state consent laws.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">13. Records Retention and Evidence Preservation<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Consent records are retained beyond legal minimums<\/li>\n\n\n\n<li>Call\/SMS logs are preserved for defense<\/li>\n\n\n\n<li>Audit trails are maintained<\/li>\n\n\n\n<li>Legal-hold procedures are implemented<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">14. Consumer Complaints and Escalation<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Complaints are logged and investigated<\/li>\n\n\n\n<li>Root-cause analysis is performed<\/li>\n\n\n\n<li>Corrective actions are documented<\/li>\n\n\n\n<li>Partners are notified where appropriate<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">15. Enforcement and Disciplinary Measures<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Violations of this Policy may result in suspension, termination, contractual remedies, and reporting to regulators where required.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">16. Relationship to the Privacy Policy and Terms<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This TCPA Policy supplements and is incorporated into the Privacy Policy and the Terms and Conditions. In the event of a conflict, the policy providing the greater consumer protection will control.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">17. Changes to This TCPA Policy<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">We may update this Policy periodically to reflect changes in law, technology, or business practices. Continued interactions after updates constitute acceptance.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">18.
